    1. We use information held about you in the following ways:

      1. to carry out our obligations arising from any contracts entered into between you and to provide you with the information, products and services that you request from us;

      2. to ensure that we comply with our legal obligations, and if necessary to exercise, establish or defend any legal proceedings;

    1. You agree that we have the right to share your personal information with:

      1. any member of our group, which means our subsidiaries, our ultimate holding company and its subsidiaries, as defined in the Companies Act 2014.

      2. selected third parties including:

        1. business partners, suppliers and sub-contractors for the performance of any contract we enter into with them or you;

        2. advertisers and advertising networks that require the data to select and serve relevant adverts to you and others. We do not disclose information about identifiable individuals to our advertisers, but we will provide them with aggregate information about our users (for example, we may inform them that 500 men aged under 30 have clicked on their advertisement on any given day). We may also use such aggregate information to help advertisers reach the kind of audience they want to target (for example, women in Dublin). We may make use of the personal data we have collected from you to enable us to comply with our advertisers’ wishes by displaying their advertisement to that target audience;

        3. analytics and search engine providers that assist us in the improvement and optimisation of our Website and/or App;

        4. credit reference agencies for the purpose of assessing your credit score where this is a condition of us entering into a contract with you.

    2. We may disclose your personal information to third parties:

      1. in the event that we sell or buy any business or assets, in which case we will disclose your personal data to the prospective seller or buyer of such business or assets;

      2. if Photoblue Limited or certain of its assets are acquired by a third party, in which case personal data held by it about its customers will be one of the transferred assets;

      3. if we are under a duty to disclose or share your personal data in order to comply with any legal obligation, or in order to enforce or apply our terms of use and other agreements; or to protect the rights, property, or safety of Photoblue Limited, our customers, or others. This includes exchanging information with other companies and organisations for the purposes of fraud protection and credit risk reduction.

    1. Personal data may be transferred in order to carry out the functions outlined in sections 3 and 4 above. Many of the countries to which personal data may be transferred, will be within the European Economic Area (the “EEA”), or will be ones which the European Commission has approved, and will have data protection laws which are the same as or broadly equivalent to those in Ireland. However, some transfers may be to countries which do not have equivalent protections and in such circumstances, we will use reasonable efforts to implement contractual provisions in relation to the transfer of personal data.

    1. Our Website and/or App may, from time to time, contain links to and from the websites of our partner networks, advertisers and affiliates. If you follow a link to any of these websites, please note that these websites have their own privacy policies and that we do not accept any responsibility or liability for these policies. Please check these policies before you submit any personal data to these websites.

You also have the right to correct any inaccuracies in, and in certain circumstances to request erasure, or restriction on the use, of your personal data, in each case subject to the restrictions set out in applicable data protection laws. Where we are relying on a legitimate purpose in order to use and disclose your personal data, you are entitled to object to such use or disclosure of your personal data and if you do so, we will cease to use and process your personal data for that purpose unless we can show that there are compelling legitimate reasons for it to continue or we need to use the personal data for the purposes of legal claims.

    3. In limited circumstances, you may also have the right to data portability in respect of you personal data, which means that you can request us to provide it to you in a structured, commonly used and machine-readable format or transfer it to your third-party nominee where this is technically feasible.

    4. You also have the right to lodge a complaint with the Data Protection Commission about the processing of your personal data.

Unless required by certain regulatory or legal obligations, we will not retain your data for longer than is necessary for the purpose for which it was retained or as required or permitted for legal, regulatory, fraud prevention or legitimate business purposes.
